General Terms and Conditions
We attempt, with precise information and appropriately clear depiction on our homepage, to create a simple and transparent booking situation for our customers. As the basis for the booking contract, the general terms and conditions and travel conditions apply, and are to be accepted without compromise. Outlined in the terms and conditions are registration and booking information and several important points pertaining to the travel conditions. We indicate hereby that we undertake bookings for our Budi Sun Resort, but that we are not a travel agency in the sense of German law.
1. Validity of offers
The travels offered on our homepage are valid for the imprinted time frame. By uncertainty please contact our Service point by email.
The application should be written per email following the application form. We assume by the written booking, that you have informed yourself of the duties and rights presented within these business- and general travel terms and conditions, and that you have confirmed your booking in writing immediately with this written email. If you wish, you can also receive this confirmation by post. With the travel confirmation you will receive the money transfer data. In this way we conserve the administrative effort, and you benefit with a cheaper booking price.
3.Terms of payment
50% Deposit after receiving the booking confirmation per bank transfer onto our specified account. The balance amounting to 50% is due 28 days before arrival at Budi Sun Resort in Indonesia. Payments on site are to be made with credit card (only VISA or Mastercard) or in cash (in €, $ or IDR). Our exchange is not determined by the current international foreign exchange rate, but can be inquired at the reception at Budi Sun Resort. In the situation that a payment with a credit card is not possible due to technical reasons, we can drive you to an ATM, where you can withdraw the balance in cash. For last-minute bookings,
(within 28 days of the beginning of the travel) the full travel payment is due. We do not administer travel cancellation insurance and health insurance. The absent of payments within the given deadline will result in a unilateral cancellation of the contract from our side, carried through by legal processes.
Package prices are discounted offers and be concluded for a fixed period of time. In case of early departure for reasons which has the Budi Sun Resort not in debt, no refund of wasted stay is granted.
Flight bookings within Indonesia can be performed on request by Budi Sun Resort. We calculate for each booking process 100,000 IDR to administrative and processing fee.
4. Travel insurance
The arrangement of a travel cancellation-, baggage-, traveler’s accident-, and travel health insurance by a private insurance company is strongly urged and highly recommended.
5. Withdrawal from a contract
The customer is obligated for the payment of cancellation fees pertaining to the cancellation of a contract within the given deadlines. For our booking, the following cancellation fees apply per person: 25% for up to 28 days before start of the travel. 50% for up to 21 days before start of travel. 75% for up to 14 days before start of travel. 100% of the travel costs are required for withdrawal within 14 days before the start of travel.
In the situation of complete absence for the travel (no-show) without notification, we will charge 100% of the travel fees. Additional cancellation fees outside of Budi Sun Resort (such as other hotels, flights, vacation houses…) are to be separately declared by the provider of these services. In the case of early termination of a travel, no entitlement of refunds will be provided which are not mentioned in the utilized services.
The cancellation must be made in the form of a self-written letter or personally with a simultaneously written declaration. The effective date of cancellation will be calculated based on the date at which the written declaration is received. For processing, 10% of the travel costs, not exceeding 50 Euro per person and respectively a maximum of 75 Euro per booking, will be charged as a processing fee. The resignation by the travel operator is possible if a provision of the agreed services should be made impossible due to an external, unforeseeable, or unavoidable event with appropriate reasons.
6. Replacement persons
In the event that a different person should attend other than the registered participant, the travel operator is then eligible to apply any additional costs caused by the participation of the newly registered replacement person (change of name for plane ticket etc.) The participant and the replacement person are liable as joint debtors of the travel costs. The travel operator retains the right to object the alteration of a travel guest if specific requirements for the travels do not suffice, or if legal regulations or administrative orders oppose the participation of the replacement person.
7.Warranty, damages, obligation to give notices of defects:
Through your travel booking you have the right that the travel services be performed exactly as they are written out. Should an error occur in the fulfillment of these assignments, either from us or a particular service provider (for example hotel, airline carrier), we are willing to settle issues as best as it is possible. We want to call to your attention, that you must immediately report instances of any lack of fulfillment in the contract which you detect during your travels, be it with those responsible at Budi Sun Resort, our representatives on site (travel guide, agency or hotel administration) or the particular service provider involved. If you feel our contractual obligation is not fulfilled, give us the opportunity for improvement or compensation. Failure of notice does not change your warranty claim, but it can be attributed as contributory negligence in this respect and reduce the eventual damage claim. To simplify the raising of a claim, we urge the customer to confirm the failure of or insufficient performance of services in written form i.e. vouchers, evidence, witnesses to attest to claims, etc. It is recommended in the best interest of the traveler to assert claims directly to the organizers immediately upon return from the trip, because longer delays could lead to difficulties of verification.
8. Luggage damage
We are not liable for damage to your luggage.
You must directly inform the service personnel at the airport of any damages to your luggage or missing items. We will help you to find the right reference person.
9. Pick-up service
On arrival at the airport in Bali Denpasar, you can request to be guided by us to your hotel or to be picked up from the hotel service at the airport. Additionally you will be brought to the airport for your connecting flight to Flores by the hotel service or one of our escorts. At the airport in Maumere, our service staff will personally pick you up.
10. Changes in price
We reserve the right to adapt the price of the travel if appropriate reasons should come forth, which are not dependent of our own will. These can be changes in transportation costs (fuel price, landing fees, airport fees, insurance fees.) The customer’s right of resignation remains unaffected if the travel price rises more than 10%. We explicitly reserve the right to adjust prices due to serious changes. This is also true for already booked trips.
11. Passport, visa, customs regulations
With the travel announcement you receive the important information, to the best of our knowledge, regarding required formalities and necessary travel documents.
Every participant is responsible for the adherence and compliance regarding his or her own travel documents. Any detriments arising from noncompliance with these regulations are at the expense of the traveler. IMPORTANT: By registration, make sure to give the correct name stated in the document (passport) that you use during your travel. We assume no liability, in the situation that the name in the registration does not match the name that is printed in the travel document. Customs and foreign exchange regulations can be handled very strictly in various countries. Please inform yourself thoroughly and obey these regulations unconditionally. 12.Entry requirements and vaccination requirements.
The travelers should inform themselves early enough about infections and vaccine protection as well as other prevention methods, and advice should be obtained from a doctor. Please refer to additional general information, in particular among health authorities, experienced medical physicians, tropical medicinal physicians, and travel medicine information services for health education.
13. Bringing pets
It is generally prohibited to bring pets along with you.
14. Hikes, mountain tours and bicycle tours.
The athletic exertion during hikes, mountain tours, and bicycle tours presents a higher risk for participants. There are also higher requirements associated with health, endurance and equipment in comparison to normal tours. Neither the travel business nor the tour guides are to be held responsibility for accidents, damages, or injuries incurred. The walking time for hikes are provided as averages and can become longer than expected due to conditions such as slower participants, bad weather, or necessary detours.
15. Sport and dive course
It is highly recommended before the beginning of your travels, to be examined by a doctor for your ability to dive. During the diving course and program, the instructions of the diving teacher or instructor are to be followed closely. Violations will result in immediate exclusion without any claim to refund. Participants who wish to perform a non-limited diving program must insure that they have the appropriate diving experience.
Participants who book a diving program must have the required and described diving experience. The competent dive guide on site retains the right, in case of lack of diving qualification, to adapt the booked diving program if necessary. The traveling participant dives at his or her own risk. Every diver should obtain a diving accident insurance. Please arrange a diving accident insurance for example by aquamed Deutschland or DAN before your travels. Diving pupils who complete a diving traineeship by Budi Sun Resort are automatically insured under our dive school on site through aquamed Deutschland.
16. Last-minute route changes by Indonesian flights
We must take into consideration, that there may be changes to the flight schedule due to unpredictable weather and traffic conditions. However, we will put effort into preserving the character of the trip for you.
17. Departure and arrival day, flight changes and transfer time
The arrival and departure days during a vacation travel primarily serve for the transportation to and from the resort. They do not count as vacation days in the proper sense. Therefore, changes in flight and transfer times within these two days are to be taken as mere inconvenience and can not be used as travel claims. We recommend that our guests return to Denpasar or Jakarta a day early on departure, so as not to experience complications with the domestic flights due to unforeseen problems, and subsequently miss their following charter flight. For flight cancellations and consequences thereof, the Budi Sun Resort is not to be held liable.
18. Departure times with charter flights
In air transportation, short-notice changes to flight times and flight routes can occur in order to better utilize the aircraft. Because of this, the travel operators state only the days of the arrival and departure flights, and not the time. Even if the tickets include departure or arrival times, these are not binding like it is with scheduled flights. Please make sure to check the time of your return flight early.
19. Scope of services
Only the service descriptions on the current website shall be binding regarding the scope of services. No claims are to be derived due to possible errors on this page.
20. Travel guide – mountain guide – bus driver – driver
The guides for all tours and diving events are employed by Budi Sun Resort and have the necessary qualifications for their duties. It is possible, however, that some of the drivers or guides can only speak Indonesian and, therefore, a direct conversation would not be possible.
We hereby declare that all of your personal data serves only to create lists of rooms and participants, to complete the necessary insurances, and for our internal use. Our catalog has been prepared with great care, but it is still subject to errors in both sentence and print.
